3 misconceptions about property division in a Texas divorce

Ending a marriage can bring uncertainty and a range of emotions. Divorce may also create financial adjustments, as it involves changing a shared lifestyle and household routines. For many, the family home is often a major concern. Spouses may rely on assumptions or advice from others, only to feel blindsided later. Clearing up these three common misconceptions can make the process less overwhelming.

Misconception 1: Everything is split 50-50

Texas is a community property state, but that does not strictly guarantee a mathematical 50-50 split. Instead, Texas law requires a division that the court deems “just and right”. For example, one spouse may have earned more while the other handled childcare. Judges weigh both financial and nonfinancial contributions when dividing property, making outcomes more balanced.

Misconception 2: The higher earner keeps the house

Income alone does not decide who keeps the home. Courts consider whether a spouse can afford the mortgage, taxes and upkeep after divorce. They also look at debts, other assets and future income potential. It is helpful to note that the court also considers who has the legal and financial ability to actually keep the home, not just who wants it. Sometimes the lower-earning spouse keeps the home for stability, especially for children, while the higher-earning spouse receives other assets.

Misconception 3: The home always goes to the custodial parent

Custody matters, but it does not automatically determine who keeps the house. Judges consider affordability, contributions to the home and the best use of marital assets. Children may stay in the family home to reduce disruption, but the court may still order a sale if that is the most practical solution.
